Terms & Conditions

Dear guest, once you have chosen your program, please read this terms and conditions as your booking is subject to the terms listed below.

Responsibilities

Cusco Tours directly operates part of the services included in the programs especially in the city of Cusco, but also makes arrangements with hotels, airlines, transportation and other independent companies to provide you with the travel services you purchase.
We take all reasonable steps to ensure that the services provider companies mantain our quality standards, offering the best services to our customers. However, these companies are independent suppliers over which we have no direct and complete control. Therefore “Cusco Tours” excludes all liability for death, injury, loss or other inconvenience caused by an act or negligence of any one of these providers.
In case of Force Majeure events as political disputes, wars, strikes, natural disasters, governmental actions, mechanical flaws, adverse weather conditions, disease, civil strifes, terrorist activities or any other beyond our control. The customer agrees to assume all additional costs arising from any of these factors. In this case “Cusco Tours” will not accept liability and reserves the right to modify, delay or even cancel the trip as a last option if it is necessary.

Acceptance of Risk

 Some of our itineraries include direct exposure to true nature or environment visited (trekking, boating, horseback riding, bicycles and others).
Therefore, it involves an element of personal risk and potential exposure, which could result in physical or emotional injury, paralysis, death, or damage to the client. The client understands that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity and therefore assumes them as part of the tour.
The client accepts that he/she is aware of his physical and health condition and that, under the knowledge of this he/she decides to undertake the above-mentioned risks. The client excludes “CUSCO TOURS” from any responsibility linked to any accident or injury that may occur associated to the clients’ health, physical condition or other.

Payment & Deposit

Our services will be provided once received, the full payment of the requested service. Our programs within TOURS IN CUSCO may be paid up to 2 days prior the beginning of the tour and the itineraries within TOURS IN PERU which include visits to other cities outside of Cusco city must be paid in full 15 days before the start of the tour. Likewise for groups larger than 10 people, the payment must be paid in full up to 15 days prior the beginning of the tour. All this in order to secure the reservation

Booking Procedures

The booking takes shape once received the deposit of 50% for programs with standard class hotels, and 60% for programs with higher categories hotels or luxury. You must send full information as full names, identity card number or passport number, date of birth, and gender, and then you will receive a written confirmation via email once the booking is confirmed by all services on the agreed dates. Any changes after the agreed date will be subject to availability and additional payment if necessary.

Prices

The rates of the program are per person expressed in American dollars and include transfers, transportation, excursions accommodation among others,(specified in program). The prices do not include the 18% of IGV applicable only to Peruvians citizens and foreign residents in Peru. Foreign tourists require to submit in the hotels their original passport and migration card for the exoneration of the tax,
The prices do not include taxes of national and international departures from the airport, visa fees, excess baggage, meals not mentioned in the program,, gratuities, insurance of any kind, laundry, telephone calls, calls or messages by radio, reconfirmation of international flights and other articles of personal use, optional tours or other services not specified explicitly in the program,

Cancellation and Refund Policy

Cancellation by the client

Any cancellation will be governed by the terms and conditions stipulated below:

  • In case of cancellation by the client, this should be notified to “CUSCO TOURS” in writing.
    Cancellations 60 days prior the trip are subject to a penalty of 15% to cover administrative costs, plus bank charges generated by the refund
    Cancellations in 59 to 21 days prior the trip are subject to a penalty of 40% , plus bank charges generated by the refund.
    No refund shall be granted or refund if the cancellation request is received with up to or less than 20 days before the date of arrival of the passengers. Similarly, no return or refund will be granted in the case of the passenger(s) not showing up or cancellation during the trip. Also there is no refund or no refund for portions of tour packages or stays unused.
    The deposits for the classic Inca trail (4 days and /or 2 days) are non-refundable.

Cancellation by us
Cancellation by “CUSCO TOURS”, reserves the right to cancel in the event of:
• Force Majeure: inability to operate the program, due to exceptional or unforeseen circumstances beyond the control of “CUSCO TOURS” such as disasters, political disputes, strikes, natural disasters, governmental actions, mechanical failures or any other outside of our control, the customer agrees to assume all additional costs arising from any of these factors, “CUSCO TOURS” reserves the right to change, postpone or even cancel the itinerary if necessary
• Client’s failure to pay the due balance prior to the departure date. In this case, the client will not have any right for the deposit refund.
• “Cusco Tours” reserves the right to cancel the program if the client does not present for the start of the program.

Claims & Complaints

If a client has a complaint against the company the client must first inform the tour conductor, guide or company representative while on the tour in order that the guide/representative can attempt to rectify the matter. Any further complaint must be put in writing to the company within 7 days of the end of the tour.
